So, it's lease renewal time (as of the 31st). It just came in the mail Friday. It's all different! She changed the wording about the appliances and now only wants to be responsible for the dishwasher (that she just had to replace), garbage disposal, and stove! Not even the fridge or built in air conditioner. She rewrote the entire section about move out to now include that we have to prime everything upon move out (which is usually standard, but our original agreement was that we could paint anything as long as we cleared the colors with her first, which we did). PLUS there's a part that says we accept the house in the condition it is and we will be responsible for the maintenence of the heating system, plumbing, etc (we are aware that there's a separated and cracked pipe between the house and sewer already)!
So...#1...If she was going to change anything in the lease she's required to get it to use 90 days in advance so we can review and still have to to give her 60 days notice. #2...our previous lease states that if we don't sign a new lease by the end of term we automatically revert to a month to month under the terms of the previous lease.
My plan (and question) is to send her back both copies of the new lease with a letter that says something to the effect of "Unforunately we are unable and unwilling to enter into a new lease contract with you at this time, but we would be more than happy to renew our previous lease/rental contract." The question....do I have every right to do that? And since our previous lease states that we would revert to a month to month under the terms of the previous lease, don't I kind of get my way no matter what? AND.....Doesn't this woman sound like the most irresponsible, bat shit crazy, MORON you've ever heard of?!

Oh, and there are other changes, like a whole in depth section about if we move before the lease is up we have to pay all these fees. J thinks that's in there for he ro get around the Sailor Soldier Act if he gets restationed early.

You can do whatever you want. Leases are just contract law. As long as they don't violate any state or federal laws and two parties agree to the terms they're fine. Think of it as contract negotiations. You can also highlight or cross out sections you don't agree with and send back to her. Good luck!

That's insane! I think you can do the month to month but she can then give you notice to vacate, and probably will.

And I thought my landlords coming in my house with the electrician this morning (to spy) was bad. They like to make sure it's kept clean. Their last tenant was a hoarder and they didn't know until it was moving time. *shuders*

She can try to get around the Salior Soldier Act, but she won't. It's a federal law.
I would NOT sign that lease. No way in hell should you be responsible for any issues with the home.
Landlords are not required to provide a fridge, so that's probably why she doesn't want to cover it any longer.
Just be prepared to move if she decides she doesn't want to do month to month, like move out at end of month.

I'm not overly concerned that she'll want us to move. She lives in California and I can't see her coming all the way here and going through court to evict us, which we would make her do Also, our original lease the area that discusses it reverting to month to month says that either party still has to give 60 days notice. The fridge thing just burns me up! I know by law the landlord doesn't have to provide a fridge, but if I rent a place for $1250 that includes a fridge I would never continue to pay that rate withOUT a fridge. It's just crazy! This dumb twat needs to get a brain like a normal person has and change what she wants to provide and not provide when she gets new tenants, not expect existing tenants to pay the same amount for less things.

I'll rent you my house for $1,000! LOL I'm in the process of putting in all new appliances - already have a new fridge, microwave over the range and dishwasher. Just need to get a new range. I'm also planning on replacing the heat pump. J/K about renting out just yet.

not expect existing tenants to pay the same amount for less things. This is what our place does except the rent raises an automatic 10% every year. 1-$200 raise was all we could afford, we're moving in a couple of weeks. They keep taking away services. Like when we signed the lease (a few months before moving here) they offered free breakfast on Saturday's and that was gone before we moved in. They offered 24 hours Starbucks coffee and then switched to generic and then started closing it no later than 6 pm, often earlier. They used to validate guest parking and now guests have to pay $20 a day. It's been over 80 degrees in our apartment for a couple of weeks and we're only on the 3rd of 17 floors, I am sure it's hotter elsewhere. They don't want to turn the a/c on until May 15th but are "considering" April 25th. They don't even pay for it! The tenants split the bill (not based on actual usage) and we get charged $5 for them to tell us how much we owe. The first year we were here it was over 100 in our apartment for 2 weeks before they turned on the a/c!! Thankfully last year I went home for 2 months and avoided it. We also have to do a 60 day notice if we're going to renew the lease or not (no month to month option unless you pay an extra $500ish a month). However, they're supposed to give us a 30 day notice of the price increase before our deadline for the lease renewal, so 90 days notice. That makes it damn near impossible to see if there is anything available to rent since everything you look at will be rented long before move out day. This year they didn't give us our rent increase letter in time and when we asked we were told they weren't going to give it to us until 2 months before the end of the lease, essentially the same day we'd be required to tell them if we want out of the lease. Shady. Then we brought the car back from Kansas and needed a parking pass ($100 a month) but they didn't have any. They could have gotten some from the parking garage but instead told us to wait a couple of weeks for move outs. They told us we could park in future resident parking (there are a few space in front of the door) but we got a notice for parking there and we would have had to pay $20 a day for visitor parking. Visitor parking is free on weekends so we just left the car in there during the week and only used it on the weekends when there was no guard. Got a notice for illegal "long term parking." SO READY TO MOVE

I was told I had to provide a stove/oven, refrigerator and heat source when we were in the process of renting out our home.
Like, if our HVAC went out, technically I wouldn't have to repair it immediately because there's a fireplace.
Maybe I should start being a shitty landlord...it would save me a bunch of money and apparently I'm in the minority, lol.
